The complainant submitted a request to National Institute for Health and Care Excellence for information relating to the percentage cost difference between two named medicines.
The Commissioner’s decision is that NICE was entitled to rely upon section 43(2) (commercial information) of FOIA to withhold the requested information. However, as NICE did not confirm that it holds the ‘building blocks’ of the requested information, within 20 working days, the Commissioner finds that it breached sections 1(1)(a), 10(1) and 17(1) of FOIA.
The Commissioner does not require further steps, as a result of the notice.
