The Commissioner’s decision is that the Chief Constable of Gwent Police (‘Gwent Police’) is entitled to refuse to confirm or deny whether it holds the requested information about an alleged incident under sections 38(2) and 40(5B) of FOIA. Confirming or denying information is held would be likely to endanger an individual’s physical or mental health and would unlawfully disclose third person personal data. The Commissioner doesn’t require further steps.
