The complainant has requested information held by Warwickshire County Council (the council) about a proposed development on a particular area of land. The council confirmed to the complainant that it does not hold information falling within scope of the request. The complainant has not disputed this in their complaint to the Commissioner, but has asked that he make a decision on various procedural matters. The Commissioner has not upheld that part of the complaint that claimed that the council has failed to comply with regulation 5(2) (duty to provide information within 20 working days), regulation 7(1) (extension of time to respond) and regulation 9(1) (advice and assistance). However, as the council failed to issue a refusal notice within the statutory 20 working days, and did not cite the exception at regulation 12(4)(a) when confirming that it did not hold the requested information, the Commissioner has found a breach of regulations 14(2) and 14(3) of the EIR respectively. The Commissioner has also found a breach of regulation 11(4) as the council failed to issue its response to the complainant’s first internal review request within 40 working days.
