The complainant has requested information from the BBC regarding correspondence between some of its departments and the Creative Industries Independent Standards Authority (CIISA) within a certain timeframe. The BBC provided some information but withheld part of it, applying section 40(2) FOIA – personal information. The Commissioner’s decision is that the BBC correctly applied section 40(2) FOIA. However, the BBC breached sections 1 and 10(1) FOIA by responding outside the statutory timeframe and failing to provide the complainant with the non-exempt information within 20 working days of their request. The Commissioner does not require further steps.
