Potto Parish Council

The complainant has requested various information from Potto Parish Council (“the council”) relating to incomplete minutes of meetings. The council responded stating that no further information is held beyond that which it has already published. As regards one part of the request, it applied section 31 to withhold the information from disclosure (law enforcement). The Commissioner’s decision is that the council was not correct to withhold information under section 31 of FOIA. He has also decided that it does not hold any further information for the purposes of section 1 of FOIA beyond that withheld under section 31. The Commissioner requires the council to take the following steps to ensure compliance with the legislation: To disclose the information withheld under section 31(1)(g) to the complainant, subject to the appropriate redaction of personal data under section 40(2) of FOIA.
