The complainant has requested information about the use of plant protection products in the Wrexham area between 2020 and 2023. The Health and Safety Executive (‘HSE’) relied on regulation 12(4)(b) of the EIR (manifestly unreasonable) to refuse the request. The Commissioner’s decision is that HSE was not entitled to rely on regulation 12(4)(b) of the EIR to refuse the request. The Commissioner requires HSE to take the following steps to ensure compliance with the legislation: Provide the complainant with a fresh response to their request that complies with the EIR and that doesn’t rely on regulation 12(4)(b).
