The complainant has requested information about the sale of land at the former Tower Ballroom site. Birmingham City Council (the Council) provided some information but withheld other information under regulation 12(5)(f) (interests of the information provider) of the EIR. During the course of the Commissioner’s investigation the Council disclosed some additional information, withdrew reliance on regulation 12(5)(f) of the EIR and maintained that the remaining information held relevant to the request was exempt under regulation 12(5)(e) (commercial or industrial information) of the EIR. The Commissioner’s decision is that regulation 12(5)(e) is not engaged in relation to the remaining withheld information. The Commissioner requires Council to disclose the remaining withheld information relevant to the request.
