The complainant has requested the Financial Analysis of a market test carried out by Hebden Royd Town Council (the council). The council has stated that it does not hold the information requested. The Commissioner’s decision is that on the balance of probabilities, the council’s response did not comply with section 1(1) and section 10(1) of FOIA. 
The Commissioner requires the council to take the following step to ensure compliance with the legislation: Disclose the financial analysis. The council must take this step within 30 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
