The complainant requested information about a financial agreement relating to the Ffos-y-fran opencast coal mine. Merthyr Tydfil County Borough Council (the Council) withheld the information under regulation 12(5)(e) (commercial confidentiality) of the EIR.
The Commissioner’s decision is that regulation 12(4)(e) is engaged, but that the public interest favours disclosure of the withheld information. 
The Commissioner requires the Council to take the following steps to ensure compliance with the legislation - Disclose the withheld information, ensuring that any personal data is redacted subject to the terms of the Data Protection Act 2018.
