The complainant made a two-part request for the dates and locations of the Charity Commission Board meetings, and for the office address of its Chief Executive. Ultimately, the Charity Commission provided the dates and city locations for the Board meetings held at the time of the request, but withheld the venues/address details, citing section 38(1)(b) of FOIA – health and safety etc. It disclosed the four office locations the Charity Commission operates from, but refused to provide the specific office address of its Chief Executive, citing sections 38(1)(b) and 40(2) – personal information, of FOIA. The Commissioner’s decision is that the Charity Commission properly relied on section 38(1)(b) of FOIA to withhold the remaining information in scope of the request. As he has found section 38(1)(b) to apply, the Commissioner has not deemed it necessary to also consider the Charity Commission’s reliance on section 40(2) of FOIA. No steps are required as a result of this notice.
