The complainant has requested details of Fixed Penalty Notices issued in respect of fly-tipping. Westminster City Council (the Council) provided some information and withheld the remainder in reliance on the exception at regulation 12(5)(b) (the course of justice) and regulation 13 (personal data) of the EIR. The Commissioner’s decision is that the Council was entitled to rely on the exceptions cited in respect of some of the withheld information. However it was not entitled to rely on regulation 12(5)(b) in respect of the requests submitted on 12 May 2024, 15 May 2024 and 3 June 2024. The Commissioner also finds that the Council failed to comply with regulation 11(3) of the EIR in that it took more than 40 working days to complete five internal reviews. The Commissioner requires the Council to disclose the information requested on 12 May 2024, 15 May 2024 and 3 June 2024, to the extent that it was withheld under regulation 12(5)(b). The Council is  not required to disclose any information withheld under regulation 13 of the EIR.
