The complainant has requested information regarding a report given in evidence at the trial of [named person]. The Crown Prosecution Service (“the CPS”) provided a response to one of the questions, however it refused to provide the information for the remaining points, citing section 30(1)(c) of FOIA – investigations and proceedings conducted by public authorities. The CPS also cited section 40(2) – personal information. The Commissioner’s decision is that the CPS is entitled to rely on section 30(1)(c) of FOIA to withhold the requested information in points two and three of the request. As the Commissioner is satisfied that section 30(1)(c) applies to the information, he did not go on to consider section 40(2) of FOIA. The Commissioner does not require further steps.
