The complainant has requested FCA to disclose emails sent or received from the mailboxes of a named officer between 1 July 2016 and the end of December 2018 relating to Collateral UK. FCA refused to confirm or deny holding the information citing section 40(5) of FOIA (personal data). The Commissioner’s decision is that FCA is entitled to rely on section 40(5) of FOIA. The Commissioner does not require further steps to be taken.
