The complainant requested information regarding an investigation into an alleged asbestos disposal on a neighbouring site. Although it confirmed the outcome of the investigation, the Department of Agriculture, Environment and Rural Affairs (DAERA) refused to disclose the test results citing regulation 13(1) of the EIR. The Commissioner’s decision is that DAERA was correct to withhold the information under regulation 13(1) of the EIR. He does not require any further steps to be taken.
