The complainant has requested FCA to disclose emails sent or received from the mailboxes of two named officers between 1 October 2017 and the date of the request relating to Collateral UK. FCA disclosed the information (with personal data redacted) for one of the named officers but refused to confirm or deny holding the information for the second individual citing section 40(5) of FOIA (personal data). The Commissioner’s decision is that FCA is entitled to rely on section 40(5) of FOIA for one of the named officers. However, he found that the timeliness of FCA’s response breached sections 10 and 17 of FOIA. The Commissioner does not require further steps to be taken.
