The complainant has requested information about various issues they have raised in connection to a suicide, from the Metropolitan Police Service (the “MPS”). The MPS would neither confirm nor deny (“NCND”) holding the requested information, citing sections 40(5A) and (5B) (Personal information) of FOIA. The Commissioner’s decision is that the MPS was entitled to rely on section 40(5A) of FOIA in respect of both sets of requests listed under headings B and C. However, he finds breaches of section 17 in respect both. No steps are required.
