The complainant has requested NHSE to disclose a copy of one page of a 1939 Transcript Book. NHSE disclosed some information but withheld the remainder, citing sections 21, 40 and 41 of FOIA. The complaint to the Commissioner only concerned NHSE’s application of section 21 of FOIA. The Commissioner’s decision is that NHSE is entitled to rely on section 21 of FOIA for the remaining withheld information but not for one small element. The Commissioner requires NHSE to disclose the sub district codes for death information withheld under section 21 of FOIA.
