The complainant submitted a request to the London Borough of Enfield (the Council) seeking a copy of a research report carried out by Jones Lang LaSalle for the Council’s Housing and Regeneration Team. The Council withheld the report on the basis of section 43(2) of FOIA. The Commissioner’s decision is that the report constitutes environmental information and therefore the request should have been handled under the EIR. The Commissioner has concluded that the report is not exempt from disclosure under regulation 12(5)(e) (commercial or industrial information). The Commissioner has concluded that the Council also breached regulation 11(4) by not completing the internal review of this request.
