The complainant has requested information from the BBC about attendance at particular meetings where media coverage of the war in Ukraine was discussed. The BBC responded that the request was covered by the derogation and so was excluded from FOIA. The Commissioner’s decision is that, if held, the requested information would be held by the BBC for the purposes of journalism, art or literature and so isn’t covered by FOIA. He therefore upholds the BBC’s position and it’s not necessary for it to take any steps.
