The complainant has requested information about contracts and current fleet capacity. The above public authority provided most of the information, but refused to provide some. It relied separately on sections 24 (national security), 31 (law enforcement) and 43 (commercial interests) of FOIA to withhold information. The Commissioner’s decision is that none of the cited exemptions apply. The public authority also breached section 10 of FOIA as it failed to disclose the requested information within 20 working days. The Commissioner requires the public authority to take the following steps to ensure compliance with the legislation: disclose the information it has relied on sections 24, 31 or 43 of FOIA to withhold.
