The complainant has requested documents submitted by the Department for Education (DfE) to the Commissioner as part of an earlier investigation and subsequent decision notice. The DfE refused the request as vexatious under section 14 FOIA. The Commissioner’s decision is that the request is vexatious and the DfE has correctly refused it under section 14(1) FOIA. The Commissioner finds the DfE breached section 1(1)(a) and 10(1) as if failed to confirm in writing that the information was held within 20 working days but no steps are required.
