Exeter City Council

The complainant requested various information from Exeter City Council (the Council) in relation to restricted enclosures listed with the decision in relation to the relocation of the Green Space Team and Disposal of the existing Green Space Depot at Belle Isle.  The Council initially refused the request in its entirety citing regulation 12(5)(e) (confidentiality of commercial or industrial information) of the EIR. Following an internal review, the Council provided a redacted copy of the  report and appendix 1 and continued to rely on regulation 12(5)(e) to withhold appendix 2.   The Commissioner’s decision is that the Council was entitled to refuse the remaining withheld information on the basis of regulation 12(5)(e) of the EIR. The Commissioner does not require any steps.
