The complainant requested information relating to a report produced for Hertford Heath Parish Council (“the Parish Council”) by AECOM regarding the Hertford Heath Neighbourhood Plan. The Parish Council’s position is that it has disclosed all of the information held within the scope of the request. The complainant disputes this. The Commissioner is not satisfied that, on the balance of probabilities, the Parish Council has disclosed all information held within the scope of the request. Specifically, this is because the Commissioner is not satisfied that the Parish Council has given adequate consideration as to whether any further information within the scope of the request is held on its behalf by either AECOM and/or Gov Resources. The Commissioner requires the Parish Council to take the following step to ensure compliance with the legislation: Issue a fresh response to the request, in line with the requirements of the EIR, which specifically addresses whether any further information within the scope of the request is held on its behalf by either AECOM and/or Gov Resources.
