Hampshire Constabulary neither confirmed nor denied holding the requested information, citing sections 40(5) (personal information) and 30(3) (investigations and proceedings) of FOIA. The Commissioner investigated Hampshire Constabulary’s application of section 30(3) to the requested information. The Commissioner’s decision is that Hampshire Constabulary is entitled to rely on section 30(3) of FOIA to refuse to confirm or deny whether it holds any information falling within the scope of the requests.
