The complainant submitted a request for information to the Driver and Vehicle Licensing Agency (“the DVLA”) for datasets relating to the number of driving licences held at each postcode.
The Commissioner’s decision is that section 40(2) (personal information) of FOIA is engaged in regards to some of the information requested in question two of the request. However where the numbers are five or over, the DVLA has failed to demonstrate that the exemption is engaged.
The Commissioner requires the DVLA to take the following steps to ensure compliance with the legislation:
Disclose the requested information to the complainant, where the number of license holders are five and above.
The DVLA must take these steps within 35 calendar days of the date of this decision notice. Information Tribunal appeal EA/2023/0048 appeal withdrawn.
