The complainant requested information from the public authority regarding its use of the Regulation of Investigatory Powers Act 2000 and the Regulation of Investigatory Powers Act 2000 Scotland within prisons. The Commissioner’s decision is that the public authority was correct to rely on section 31(3) to neither confirm nor deny it held some of the requested information and where it did confirm it held requested information it correctly relied on section 31(1)(a) not to communicate it to the complainant.
