December 2024
Minor amendment to section 22 guidance: we have made some minor changes to our section 22 detailed guidance. We have removed the heading “Any public authority holding the information” and the paragraph sitting underneath which said that – where information had been circulated between more than one authority – any of the public authorities holding that information could apply section 22.
This is to clarify our position that we consider that it’s only the authority that it’s holding the information with the intention to publish it that can claim the exemption. This means that, if an authority is holding the information but it’s not the authority which also intends to publish it, it cannot rely on section 22. We have also changed paragraph 5, which now sets out the three steps a public authority must follow to engage the section 22 exemption”.
