The complainant submitted an information request to The National Archives (TNA) for six judgements published on the Find Case Law website, requesting them in Word document format.
TNA applied section 21(information accessible to applicant via other means) of FOIA to the six judgements, and applied section 40(2) (third-party personal data) of FOIA to the metadata contained within the Word documents.
The Commissioner’s decision is that TNA was entitled to rely upon sections 21 and 40(2). Given this decision, section 11 of FOIA which concerns the means of communicating the information is not relevant.
The Commissioner does not require further steps, as a result of this notice.
