The complainant requested a copy of a Planning Contravention Notice (PCN) and the associated response concerning land at Tower Garage, Winsford. Cheshire West and Chester Borough Council (the “council”) withheld the information under regulation 12(5)(b) (course of justice) and regulation 13 (personal data) of the Environmental Information Regulations 2004 (EIR). The Commissioner’s decision is that the council was entitled to rely on regulation 12(5)(b). Regulation 13 also applies to the personal data within the withheld information. The Commissioner does not require the council to take any steps.
