The complainant requested information related to a planning application for a wastewater pumping station. Lisburn & Castlereagh City Council (the Council) provided some information falling within the scope of the request and advised that other information was not held.  

The Commissioner’s decision is that, on the balance of probabilities, the Council does not hold any additional information relevant to the request. 

However, he has found that the Council breached regulation 11(4) of the EIR because it failed to comply with the requirement to provide the outcome of its re-consideration within 40 working days. 

The Commissioner does not require further steps.
