1.    The complainant has requested information from North East Lincolnshire Council (“the Council”) regarding previous communications with the ICO. The Council refused to disclose some of the requested information, citing section 36(2)(c) (Prejudice to effective conduct of public affairs) of FOIA.
2.    The Commissioner’s decision is that the Council was not entitled to rely on section 36(2)(c) to refuse the request. 
3.    The Commissioner requires the following step to be taken as a result of this decision:-
•    To disclose to the complainant the information that it has withheld under section 36(2)(c) removing personal data in accordance with section 40(2) as set out in the Confidential Annex to this Notice.
4.     The Council must take these steps within 30 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
