The complainant has requested information about Rivercourt Road traffic management measures. The final position of London Borough of Hammersmith & Fulham (‘the council’) is that, at the time of the request, the information was excepted from disclosure under regulation 12(4)(d) of the EIR. This exception concerns material which is still in the course of completion, etc. In the interim, some information relevant to the request has been published. The Commissioner’s decision is that at the time of the request, the Penalty Charge Notice statistics requested in parts 1, 2 and 4 of the request weren’t “incomplete data” and so these parts of the request didn’t engage regulation 12(4)(d). The Commissioner requires the council to take the following step to ensure compliance with the legislation: Disclose to the complainant the information requested in parts 1, 2 and 4 of their request.
