The complainant has requested HSE to disclose information relating to a health and safety investigation relating to risk, aggression and violence at Airedale Centre for Mental Health (ACMH) in 2019. HSE refused to disclose the information, citing section 30(1)(b) of FOIA (investigations and proceedings). The Commissioner’s decision is that HSE is entitled to rely on section 30(1)(b) of FOIA in this case. It however breached section 17 of FOIA by failing to issue its refusal notice to the complainant within 20 working days of the receipt of the request. The Commissioner does not require further steps.
