The complainant requested “all documents” associated with an investigation into the death of a named individual at a specified location run by Clearspring Ready Homes. The Home Office refused to provide any information citing the following FOIA exemptions: section 38(1) – health and safety, section 40(2) – personal information and section  41(1) – information provided in confidence. During the course of the Commissioner’s investigation, the Home Office revised its position and now said it did not hold the requested information. The Commissioner’s decision is that on the balance of probabilities, no recorded information is held by the Home Office about the investigation specified by the complainant, for the reasons set out in this notice. No steps are required as a result of this notice.
