The complainant has requested correspondence relating to Palantir Technologies’ “Nectar” and “Foundry” systems. Leicestershire Police cited section 14(1) (Vexatious requests) of FOIA to refuse the request. The Commissioner’s decision is that section 14(1) is not engaged. He also finds that by failing to respond to the request within the statutory time limit, Leicestershire Police breached sections 1(1)(a) and 10(1) of FOIA. The Commissioner requires Leicestershire Police to issue a fresh response to the request which does not rely on section 14 of FOIA. Leicestershire Police should confirm whether or not information in scope of the request is held. If held, it must disclose the information or issue a refusal notice that complies with section 17(1) of FOIA.
