The complainant has requested a copy of a file they believe should have been transferred to the Public Record Office of Northern Ireland, part of the Department for Communities. The Public Record Office of Northern Ireland (“PRONI”) initially stated it did not hold the requested information. During the course of the Information Commission’s investigation, PRONI revised its position to rely on section 12(1) (cost of compliance). The Commission’s decision is that PRONI is entitled to refuse the request on the basis of section 12(1).
