  • Decision(s) FOI 40: Not upheld

The complainant requested information on the lease for East Lodge, Sunninghill Park associated with Andrew Mountbatten-Windsor. Ultimately, The Crown Estate (‘TCE’) provided a copy of the lease requested at part 1, but refused to provide the name of the staff member occupying the premises. TCE relied on the FOIA exemptions in sections 40(2) – personal information, 38(1) – health and safety, 41 – information provided in confidence and 43(2) – commercial interests to withhold this information. The Commissioner’s decision is that TCE has properly relied on section 40(2) of FOIA in relation to part 2 of the request for the reasons set out in this notice. He has, therefore, not deemed it necessary to consider TCE’s additional reliance on sections 38, 41 and 43 of FOIA applied to the same information. No steps are required as a result of this notice.
