The complainant has requested information about Northumbria Police’s work in relation to Connect. Northumbria Police refused to provide any of the information, applying sections 43(2), 44(1) and 40(2) FOIA. However, later on Northumbria Police did provide the information requested under part three of the request. The Commissioner’s decision is that section 43(2) FOIA is engaged but that the public interest favours disclosure. The Commissioner has decided that section 44(1) FOIA is not engaged. He has also found that Northumbria Police breached sections 1(1)(b), 10(1) and 17(1) FOIA in failing to respond to the request until after 20 working days had elapsed or providing information to the complainant that it later disclosed. The Commissioner requires Northumbria Police to take the following steps to ensure compliance with the legislation. • Disclose the information withheld under sections 43(2) and 44(1) FOIA regarding part one and two of the request.
