The Commissioner’s decision is that the Equality and Human Rights Commission was entitled to aggregate and refuse to comply with the complainant’s requests for information about its work. Complying with the requests would exceed the appropriate cost limit under section 12(1) of FOIA. There was no breach of section 16(1), which concerns advice and assistance, but the timeliness of the refusal didn’t comply with section 17(5) of FOIA. The Commissioner doesn’t require further steps.
Correction: One finding in this decision isn’t correct. There was no breach of section 17(5) of FOIA as EHRC provided a section 12 refusal on the 20th working day following the date it received the request.
