Secretary of State for the Home Department (Home Office)

  • Date 19 January 2026
  • Sector Central government
  • Decision(s) FOI 12(1): Upheld, FOI 16: Upheld

The complainant made a five part request for information about immigration fraud. The Home Office refused parts one to four of the request under section 12(1) of FOIA (cost of compliance) and section 21(1) of FOIA (information accessible to applicant by other means).
The Commissioner’s decision is that the Home Office was correct to rely on section 12(1) of FOIA to refuse part one to four of the request. The Commissioner also finds that the Home Office complied with its section 16 obligation to offer advice and assistance.
The Commissioner does not require further steps to be taken.
