1. The complainant requested from Swansea Council (“the Council”) inspection reports and maintenance records in respect of a specified road. The Council refused to disclose the requested information, citing regulation 12(5)(b) of the EIR as a basis for non-disclosure.
2. The Commissioner’s decision is that the Council is entitled to rely on regulation 12(5)(b) of the EIR – the course of justice, to withhold the requested information.
3. The Commissioner does not require the Council to take any steps as a result of this decision notice.
