Devon and Cornwall Police (“D&CP”) neither confirmed nor denied that it held the information requested by virtue of section 40(5) of FOIA (personal information). 
The Commissioner’s decision is that D&CP should have stated specifically that it was relying on section 40(5A) of FOIA to refuse to confirm nor deny whether any information was held.
The Commissioner does not require further steps.
