The complainant has requested information relating to section 106 payments. Bristol City Council (“the council”) disclosed some information however it said that other information is not held by it. The complainant believes that the council is under a duty to hold that information. They have also complained that the information which was disclosed was not disclosed in one of the formats in which they requested it. The Commissioner’s decision is that the council has failed to demonstrate, on a balance of probabilities, that it does not hold any further information falling within the scope of the request. He has also decided that the council’s disclosure of information did not comply with the requirements of Regulation 6(2) of the EIR. The Commissioner requires the council to take the following steps: to disclose the information it previously disclosed to the complainant in PDF format in Excel format. To carry our further searches in line with paragraphs 34 – 40 below, and to issue a fresh response to the complainant in compliance with Regulation 5(1) of the EIR.
