North West Regional College

The complainant has requested information from North West Regional College (NWRC) about its funding. Initially, NWRC refused the request in its entirety, citing section 43(2) (Commercial interests). However, during the Commissioner’s investigation, it said it was only withholding part of the information under section 43(2). It said it had already disclosed the remaining information to the complainant, when responding to an earlier request. The Commissioner’s decision is that section 43(2) was not engaged in respect of parts (1) and (2)(i) & (ii) of the request and that NWRC has not properly complied with section 1(1) (General right of access) of FOIA in respect of parts (3) and (4) of the request. The Commissioner requires NWRC to disclose the information requested in parts (1) and (2)(i) & (ii) of the request and to issue a fresh response to parts (3) and (4) of the request, that conforms with section 1(1) of FOIA.
